West Virginia Rules of Civil Procedure — Service of Process

WV R. Civ. P. Rule 4(d) — Personal Service

Under West Virginia Rule 4(d), service of process upon an individual may be made by delivering a copy of the summons and complaint to that individual personally, by leaving copies thereof at the individual's dwelling house or usual place of abode with a person of suitable age and discretion who resides there, or by delivering a copy of the summons and complaint to an agent authorized by appointment or by law to receive service of process. WV R. Civ. P. Rule 4(d)(5) — Service on Organizations

For corporations, partnerships, or unincorporated associations, service under Rule 4(d)(5) is made by delivering a copy of the summons and complaint to an officer, a managing or general agent, or any other agent authorized by appointment or law to receive service. Registered agent service through the West Virginia Secretary of State's office is a routine service type for our corporate clients. WV R. Civ. P. Rule 4(e) — Service by Publication

Where personal service cannot be accomplished after diligent attempts, Rule 4(e) allows for service by publication for certain classes of defendants. Same-Day Service — $150

Same business day attempt when order received by 12:00 PM ET. Ideal for domestic violence protective orders, emergency custody orders, and TROs requiring immediate service. Available 365 days per year.

Skip Trace Add-On — $45: When you have a stale or undeliverable address, our skip tracers use LexisNexis, TLO, WV DMV records, and public filings to locate your subject within 24–48 hours before re-attempting service.
